RMG Sunset Restaurants Living Wage Class Action Lawsuit

RMG Sunset Restaurants Living Wage Class Action Lawsuit claims that the defendant, RMG Sunset, Inc. added living wage surcharges to the customers’ bill without disclosing to them. The lawsuit alleges the Restaurants for the violation of Consumer Protection laws and engaged in unfair, deceptive practices and false advertising. But the defendants deny all the allegations against them.

The case is entitled South v RMG Sunset, Inc., Case Number BC652905, in the Los Angeles County Superior Court and filed by the plaintiff, Jay South. He sued the defendants, the Restaurants and their managing company, The Sunset Restaurant Management Group.

The Restaurants are:

  • Cabo Cantina
  • Baja Beach Café
  • Fiesta Cantina
  • PB Cantina
  • Jameson’s Irish Pub
  • Sunset Trocadero Lounge

The Settlement

The court did not make a decision in favor of any party. But to resolve this matter and avoid the uncertain outcome, risk of litigation and also other difficulties and delays, both the Plaintiff and the Defendants have agreed to make a Settlement of 6.1 million dollars. The Settlement is approved by the court.

Eligibility for Refund

If you were charged for an undisclosed state living wage surcharge at one of the Restaurants (list is given below) within The Sunset Restaurant Management Group at any time between January 1, 2012, and May 31, 2017, you are included in the RMG Sunset Restaurants Living Wage Class Action Lawsuit and eligible for a potential award.

You can get a full refund for the amount you spent in living wage surcharges if you submit a copy of the receipt of those payments.

If you are not able to submit the receipt but sign a Declaration under penalty and perjury, you can claim a $3 payment via check or a voucher to get a 10% discount on your next visit to any of the above-mentioned restaurants.

To exclude yourself from the Settlement

If you want to get out of the settlement, you have to mail a request letter to the Settlement Administrator. In the written request, you need to mention:

  • Your full name
  • Your address
  • Your email address
  • A clear statement about your exclusion from the Settlement

Important Notes about The Settlement

  • The Final Approval Hearing will take place on August 3, 2018, at 11 am.
  • Your claim must be filed by May 21, 2018.
  • Your exclusion or objection request must be submitted by 30 April 2018.
  • All the class members as “Class Counsel” will be represented by Timothy E. Campen from Slattery, Sobel & DeCamp LLP.
  • The Defendant’s Counsel hired Moe Keshavarzi from Shepperd Mullin Richter & Hampton LLP.
